By using HabitsQuest, you agree to these Terms.
Please read them carefully before using the application.
1. Acceptance of Terms
By downloading, installing, or using HabitsQuest ("the Application"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Application.
2. Description of Service
HabitsQuest is an educational iOS application that offers:
- 13 types of activities: Quiz, Poems, Lists, World Flags, Sudoku, EquationGrid, Mental Math, Color Sort, Memory, Color Memory, Number Sequence, Breathing, Meditation
- XP progression and level system
- 3 evolving totems: Penguin, Fox, Falcon (7 evolution stages)
- Statistics and progress tracking
- Free iCloud synchronization for all users
- 1 activity per day per category (free limit)
- Optional Premium features (subscription)
3. License to Use
3.1 License Granted
We grant you a limited, non-exclusive, non-transferable, and revocable license to:
- Download and use the Application on your personal iOS devices
- Access free features without time limitation
- Use Premium features if you have an active subscription
3.2 Restrictions
You MUST NOT:
- ❌ Copy, modify, distribute, or create derivative works of the Application
- ❌ Reverse-engineer, decompile, or disassemble the Application
- ❌ Use the Application for commercial purposes without authorization
- ❌ Remove, alter, or obscure any proprietary notices
- ❌ Use bots, scripts, or automated tools
- ❌ Share your account or Premium subscription with others
4. User Accounts
- Eligibility: You must be 4 years or older to use the Application.
- Parental Consent: Users under 13 require parental consent for Premium subscriptions.
- No Account Required: The Application does not require account creation.
- Apple ID: iCloud synchronization uses your existing Apple ID.
- Responsibility: You are responsible for the security of your devices.
5. Premium Subscription
5.1 Premium Features
The Premium subscription unlocks:
- ✅ Unlimited activities (no daily limit)
- ✅ Degressive XP system for replays (100% → 50% → 0%)
- ✅ Daily streak bonus (x1.1 multiplier after 7 days)
- ✅ Custom content creation (quizzes, poems, lists)
5.2 Pricing and Payment
- Available Plans: HabitsQuest offers Monthly and Yearly subscriptions.
- Current Pricing: Exact prices for each plan are clearly displayed in the Application before purchase confirmation.
- Taxes and Localization: Prices are localized based on your App Store account region and include applicable taxes (such as VAT) according to local regulations.
- Annual Savings: The Yearly plan typically offers a significant discount compared to the total cost of twelve monthly payments.
- Payment Processing: All payments are charged to your Apple ID account upon purchase confirmation.
5.3 Auto-Renewal
- Auto-Renewal: The subscription renews automatically
- Billing: 24 hours before the end of the current period
- Cancellation: Cancel at least 24 hours before renewal to avoid charges
- Management: iOS Settings → [Your Name] → Subscriptions
5.4 Free Trial Period
- Availability: If offered, mentioned during purchase
- Duration: Typically 3 or 7 days (depending on promotion)
- Cancellation: Cancel before the trial ends to avoid charges
- Limitation: Only one free trial per Apple ID
5.5 Restore Purchases
- Tap "Restore Purchases" in Premium → Subscription
- Available on all devices using the same Apple ID
- Free and instantaneous
6. Refund Policy
All purchases are managed by the Apple App Store.
7. Intellectual Property
7.1 Our Property
- App: All code, design, graphics, and text belong to Fabien Duvacher
- Brand: "HabitsQuest" and logo are registered trademarks
- Content: Quiz questions, poems, and games are protected by copyright
7.2 Your Content
- Ownership: You retain all rights to the content you create
- License: You grant us a license to store and display your content
- Responsibility: You are responsible for the content you create
- Deletion: You can delete your content at any time
8. Prohibited Content
When creating custom content, you MUST NOT include:
- ❌ Illegal, hateful, discriminatory, or violent content
- ❌ Pornographic, sexually explicit, or inappropriate content for children
- ❌ Intellectual property violations (plagiarism, copyright)
- ❌ Personal information of others
- ❌ Spam, malware, or malicious content
- ❌ Hate speech, harassment, or bullying
⚠️ Violation: We reserve the right to remove inappropriate content and terminate your access without refund.
9. iCloud Synchronization
- Availability: Free for all users
- Storage: Uses your personal iCloud space
- Compatibility: iOS 16.0+ required
- Responsibility: We are not responsible for Apple's iCloud issues
- Data: Progress, XP, levels, custom content
10. Limitation of Liability
10.1 Disclaimer
THE APPLICATION IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.
- ❌ We do not guarantee the App will be error-free or uninterrupted
- ❌ We are not responsible for data loss
- ❌ We do not guarantee educational outcomes
- ❌ We are not responsible for device issues
10.2 Limitation of Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Our total liability will not exceed the amount paid (last 12 months)
- We are not liable for indirect, consequential, or special damages
- We are not liable for loss of profits, revenue, or data
11. Indemnification
You agree to indemnify us against any claims resulting from:
- Your violation of these Terms
- Your created custom content
- Your use of the Application
- Your violation of third-party rights
12. Termination
12.1 By You
- Delete the Application from your devices
- Cancel your Premium subscription in iOS Settings
- Your local data will be deleted
- Your iCloud data will remain until manually deleted
12.2 By Us
We may terminate your access immediately if:
- You violate these Terms
- You create prohibited content
- You use the App in an abusive manner
- Required by law
13. Changes to Terms
- We may modify these Terms at any time
- Changes will be published with a new "Update Date"
- Your continued use constitutes your acceptance
- Significant changes will require your explicit acceptance
14. Governing Law and Jurisdiction
- Law: French law and European Union law
- Jurisdiction: Competent courts of France
- Language: In case of conflict, the French version prevails
15. Miscellaneous Provisions
15.1 Entire Agreement
These Terms constitute the entire agreement between you and us.
15.2 Severability
If any provision is invalid, the others remain in effect.
15.3 Waiver
Our failure to exercise a right does not constitute a waiver of that right.
15.4 Assignment
You may not transfer these Terms. We may transfer them with notice.
